Terms of Service – TerraBetuwe

These Terms of Service govern every order placed through terrabetuwe.com (the "Website"), operated by LVSLN "TerraBetuwe". By placing an order, you agree to these terms.

1. About TerraBetuwe

TerraBetuwe is a Netherlands-based specialist in rare aroids (Alocasia, Monstera, and related genera), selling to plant collectors across the Netherlands and the EU.

2. Applicability

These Terms of Service apply to every offer made by TerraBetuwe and every order placed via the Website. By completing an order, you confirm you are at least 18 years old (or of legal age in your jurisdiction) and have the legal capacity to enter into a contract.

3. Offers and Prices

All prices on the Website are listed in euros (€) and include applicable VAT, unless stated otherwise.
Shipping costs are shown separately during checkout and in our [Shipping Policy].
Product descriptions and images are as accurate as possible. Because we sell living plants, natural variation in size, color, and leaf pattern between the photographed specimen and the plant you receive is normal and not a defect.
Obvious errors or mistakes in an offer (e.g. an evident pricing error) do not bind TerraBetuwe.
We reserve the right to limit order quantities, particularly for rare or limited-availability specimens.

4. Orders and Contract Formation

A contract is formed once TerraBetuwe confirms your order by email. TerraBetuwe reserves the right to refuse or cancel an order — for example in case of stock issues, a pricing error, or reasonable doubt about the buyer's identity or ability to pay — in which case any payment already made will be refunded.

5. Payment

Payment is due at the time of ordering, via the payment methods offered at checkout. TerraBetuwe reserves the right to only ship an order once payment has been received in full.

6. Delivery and Shipping

Shipping regions, methods, costs, and delivery times, as well as our packaging standards and Live Arrival Guarantee for damaged plants, are set out in full in our separate [Shipping Policy], which forms part of these Terms of Service.

7. Right of Withdrawal (Herroepingsrecht)

Under EU and Dutch consumer law, most online purchases are covered by a 14-day right of withdrawal. However, living plants are perishable goods that deteriorate or expire rapidly, and are therefore excluded from the right of withdrawal under Article 6:230p(d) of the Dutch Civil Code (implementing Article 16(d) of EU Directive 2011/83/EU). This means that, in principle, orders for live plants cannot be returned simply because you changed your mind.

This exclusion does not affect your rights under our [Live Arrival Guarantee] (see our Shipping Policy) or your statutory rights regarding defective or non-conforming products (see Section 8 below).

Non-perishable items sold via the Website, if any (e.g. pots, tools, accessories), remain subject to the standard 14-day right of withdrawal unless stated otherwise at the time of purchase.

8. Conformity and Warranty

TerraBetuwe guarantees that products delivered conform to the order at the time of delivery. If a plant arrives damaged or unhealthy due to transport, our Live Arrival Guarantee applies (see [Shipping Policy]). Outside of transport damage, statutory warranty rights regarding non-conforming products under Dutch and EU consumer law remain unaffected.

Because plants are living organisms, TerraBetuwe cannot guarantee results after delivery that depend on the customer's care, environment, or growing conditions.

9. Liability

TerraBetuwe's liability is limited to the purchase price of the relevant order, except in cases of intent or gross negligence on our part. TerraBetuwe is not liable for indirect or consequential damage, including but not limited to loss of other plants in your collection, unless required by mandatory law.

10. Intellectual Property

All content on the Website — including text, photographs, logos, and the TerraBetuwe name and branding — is the property of TerraBetuwe or its licensors and may not be reproduced or used without prior written permission.

11. Force Majeure

TerraBetuwe is not liable for delay or failure to perform an obligation caused by circumstances beyond its reasonable control, including but not limited to extreme weather affecting shipping, carrier disruptions, customs delays, or regulatory restrictions on plant trade (e.g. CITES or phytosanitary requirements).

12. Complaints

Complaints about an order should be submitted to info@terrabetuwe.com. We aim to respond within [NUMBER] business days. If a complaint cannot be resolved by mutual agreement, it may be submitted to the European Commission's Online Dispute Resolution (ODR) platform at ec.europa.eu/consumers/odr, or to the competent Dutch court.

13. Applicable Law and Jurisdiction

These Terms of Service are governed by Dutch law. Any dispute that cannot be resolved amicably will be submitted to the competent court in the Netherlands, without prejudice to any mandatory consumer protection rights you may have in your own country of residence.
